New York nightclub fights back against Parker's lawsuit

The New York City nightclub where the Spurs’ Tony Parker got his eye cut during a fight between rappers Chris Brown and Drake isn’t just going to take Parker’s $20 million lawsuit lying down.

Lawyers for W.i.P. nightclub say that the fight between Drake and Brown was an “unforeseen and unexpected incident” and they shouldn’t be held responsible if two guys want to throw down in their club.

Apparently Parker thinks the club should have known that these two have a feud going on but W.i.P. claims it’s not their responsibility to keep up with what those hooligans are doing on Twitter.

“(Parker) appears to argue that (the club) owed a duty to control the conduct of the Brown and Drake entourages because there was purported ‘bad blood’ between Brown and Drake,” reads a filing by defense lawyer Je Jun Moon. “The negligence claim is based on the unsupportable implication (the club) had a duty to monitor through the media the social relationship of W.I.P. patrons.”

Looks like Tony Parker won’t get to be a millionaire after all (eye roll).

To me, this whole thing is ridiculous. If Tony Parker wanted to sue anyone, it should be Chris Brown or Drake, not the nightclub. You know the dangers when you go out partying in New York. There’s drinking, drugs and a bunch of dudes trying to take the prettiest girl home. The chance for a brawl is always there.

Parker just needs to suck it up, be glad that he wasn’t injured so badly that it cost him his career and just move on. He could also think of this as a red flag. He’s a professional athlete that should take better care of himself. Yes, athletes are allowed to have social lives, but when you’re out living it up on the town, be prepared for the consequences.

And that’s my moral soapboxing for the day.

Although I do agree that a lawsuit should have been primarily against the offending parties, a nightclub does have some culpability in that they have to have sufficient safeguards in place to protect customers.

 @Spursfan66 we dont really know what exactly happened, how long the fight lasted, or what the bar actually did to stop/prevent the situation from happening. every bar i have been to where a fight broke out, it takes a bit of time for the word to get to security and for security to get to and stop the situation. now i can tell you im sure all parties involved had a bit of "security" of their own, so did that speed up or slow down the bar from doing its duty? 

 

we dont really know the whole story and never will im sure but my contention is the best prevention is to not be there in the 1st place. i am a brazilian jiu jitsu instructor and we always teach (especially to children) the best escape is to not get in the situation in the 1st place.

 @JohnAbney I'm not presuming to know all the details either. But from the vids I saw of it, it seemed obvious that the club security was COMPLETELY ineffective if not almost non-existent.

 

And as far as TP not being there, I'm pretty sure he didn't expect Drake to show up either, much less start a melee. And frankly I don't buy that a NY club that hosts such personalities had no idea that these 2 guys had issues. I'm not even remotely into that scene and even I had heard/read stories about their situation before this happened.

 

What it boils down to for me is that TP has every right to do what he did, and it just might end up making places like this more safe in the long run. That could even be TPs primary reason for doing it. I doubt that $ is his only reason.

tony is an idiot if he really thought this was going to work. he had/has a duty to his TEAMS to not put himself in situations like this in the 1st place. these guys where/are his friends, he knew the bad blood, maybe NOT HANGING OUT WITH THEM in the 1st place would have remedied the situation? 

 

if you have 2 "friends" who hate each other, then common sense tells you either keep them apart or dont be there when they are together.

 @JohnAbney The report says TP was with Brown, NOT hanging out with both of them. Drake was reported to have arrived after they did and started the fight himself by sending over some note about screwing rihanna or something.

 

Hindsight is 20/20 and I'm sure TP did not see this coming. It's not like he went out skydiving in 25 knot winds or something..he went to a club just like you and I both have I'm sure.
